Call to Order:  5:30 p.m.
Minutes accepted.


Council on Aging exterior grease traps:  The board understands concern and they are comfortable with the decision that the grease traps in place for the senior center are sufficient. They have discussed the frequency of inspections.  Health Director Cathy Cardinale said there was no issue with the inspection so there is nothing to bring to the Board. A handful of restaurants do not have grease traps. The board is comfortable with the collaboration between the BOH and Building Department.  The Director said the engineer deals with sewer issues. Ms. Jassett said the protocol to collaborate with other departments works now; if it doesn’t work in the future they can stiffen the regulations. Dr. Cramer suggested that they revisit the matter in 4 months.


Rail Concerns:  Mr. Brogan said he read through a packet that raised issues of ownership.  Ms. Jassett said ownership is not their purview. Mr. Brogan said an issue of potential contamination was raised.  A resident asked about the packet. The resident said that the corridor was capped in 2002 by the Dedham Department of Public Works under the oversight of the MA Department of Environmental Protection.  This was the first step to build a rail trail. The BOH members were given a copy of the 2002 document. The Director said that the best option was to cap the corridor. Mr. Brogan said it has already been capped according to the document.  Ms. Jassett said it was done by Mr. Keene and she is satisfied that the issue was addressed. A resident asked if the public has a right to the information the BOH received. Mr. Brogan said the concerns about contamination were voiced verbally.  Ms. Jassett said people may report concerns anonymously. The Director said the rail ties are fine and she has no concern about arsenic.


A resident asked if the BOH accepts the document from the state DEP that the corridor was capped. The Director said the Town capped the area in Dedham at the recommendation of the state.  The Director said she is absolutely satisfied with the report. Mr. Brogan said the best practice was followed so the issue of contamination has been addressed to their satisfaction.


Ask if any open questions:  Resident asked if BOH knows when Horse Thieves Tavern will open.  Director said she has had a phone call about final plans and they may see something soon.


Red Sox Camp hearing on license suspension
Elyse Graziano, Manager and Joseph Graziano, CEO/General Counsel of Headfirst Co. spoke.  They partner with 7 baseball franchises, including Red Sox since 2011, to run summer camps.  The camps serve thousands of kids in 14-16 states. It is a one week camp. It was held at the Rashi School in 2015 and 2016. The Director said they had a lot of violations in 2015, and they were told they would not get a license in 2016 if they did not comply.  One violation was failure to maintain CORI and SORI records at the site. They had many violations in 2016. The Director said she spoke with the camp manager who was rude. She said this was discussed in the July minutes. She said she sent the application and fees back to the company along with a list of violations. She said that town counsel and the district attorney were involved.  The Director did not hear anything until 2/25/18 when the company reached out about a license.


The company general counsel said he spoke with the Director in 2015. He said her characterization of emails was incorrect.  He said the company never received anything in 2016 about violations. They have never had a licensing violation in any other community.  They did not operate in 2017 because the Red Sox mandate is for them to change towns. He said they have a binder with CORI and SORI reports but they think the best practice is not to print them out or leave them in the trailer. They offered to send them in a password-protected electronic file. If they had received notice of violations in 2015 or 2016, they would have responded. The regulation carries a fine and they were not fined because they did not know of any violation. They now understand that Dedham wants them printed so they will comply.  The Director said she prefers them printed and kept in a lock box. She said when she went to inspect the premises and asked about the CORI forms the manager looked at her like she didn’t know what she was talking about. Their trailer was outside and open with nothing secured. She explained the regulations. The person who does the CORI/SORI should be present and the BOH has the right to review the forms. The general counsel agreed, but disagreed that keeping the forms onsite is proper. A camp director and a safety person are on site. CORI/SORI is an HR function.  The general counsel said no one came to inspect in 2016.


Mr. Brogan asked about other issues.  The Director said they did not have telephone line, background information, employee files, applications, CORI/SORI, or lockbox for medication.  General Counsel said each town is different and they meet with each one. The camp is one week. The inspection happens during the week. They do not have list of violations for 2015 or 2016.  They were not inspected in 2016. General Counsel said they have an email saying their binder was “out of order.” They were prepared of an inspection. The Director said they usually review the binder in advance and inspect on the first day of camp.  The Director said company applied and paid fee, but were not inspected. She felt like the Department was brushed off.


Ms. Jassett said the 7/27/16 minutes have an issue about an unlicensed camp.  They were told the year before that they would not get a license the next year. They were told they needed to come in. The Director said the person at the camp was angry and asked if town would close them down if they didn’t come in.  The company manager said Rashi asked them to come back. Mr. Brogan said they should ask Rashi to come to a meeting. The company Manager said they are fully prepared to do whatever the town wants. They want to show they are professional and take safety seriously.


Mr. Brogan said the issue is what happened in 2015 and 2016.  The Director showed certified letters that were sent to company president and general counsel.  The letters had the return receipt cards attached.


The company was asked about medication for campers.  They said they have a one-on-one medical plan for each camper. The camp manager carries an epipen.  They have access to the Rashi cafeteria for refrigerator if needed. The Director said they have to show the inspector a secured box for medication.  The general counsel said they handle thousands of medical situations.


Mr. Brogan asked what they want from the Board. They had not formally applied for a permit.  The company said the Director told them not to apply because they would be denied. Mr. Brogan said they need to apply and get response from the Director.  If the permit is denied, they can appeal to the Board. Ms. Jassett suggested that they get information from Rashi and speak with town counsel. The camp is 8/6-8/10.  Dr. Cramer said the department has legitimate questions. There were deficiencies in 2015 and they operated without a permit in 2016.
